These Billing Terms are incorporated into the ClosingLeads Terms of Service and govern all payments and referral transactions made in connection with ClosingLeads’ Pay-at-Closing Program (the “Program”). In the event of a conflict between these Billing Terms and the Terms of Service, these Billing Terms shall control.
- 1. Enrollment Fee. To activate your participation in the Program, you agree to pay a one-time Enrollment Fee. This fee covers campaign setup, lead verification, and territory activation. The Enrollment Fee is non-refundable but will be fully credited toward your first referral payment due at closing. There are no recurring monthly or subscription payments under this Program.
- 2. Referral Payments at Closing. When a transaction generated through ClosingLeads’ leads results in a successful real estate closing, you agree to pay the agreed-upon referral fee (“Referral Payment”). This fee is typically calculated as a percentage of the gross commission earned by you or your brokerage and is defined in your Referral Agreement. Your Enrollment Fee will automatically be applied as a credit toward your first Referral Payment.
- 3. Payment Method. All payments must be made using a valid credit or debit card issued by American Express, MasterCard, Discover, or Visa (“Payment Method”). You must keep your Payment Method details and contact information up-to-date in your account settings. By submitting a Payment Method, you authorize ClosingLeads to charge it for all amounts due under these Billing Terms.
- 4. Billing Authorization. You authorize ClosingLeads to automatically charge your Payment Method for:
- (a) The one-time Enrollment Fee at the time of registration.
- (b) Any Referral Payments due upon the successful closing of a transaction that originated through ClosingLeads leads.
All charges may be processed directly by ClosingLeads or via an authorized third-party payment processor. You agree to promptly resolve any billing issues or disputes in good faith. - 5. Refunds and Credits. The Enrollment Fee is strictly non-refundable but will be applied as a credit toward your first Referral Payment. If you do not close a transaction through the Program, no refund or additional credit will be issued. Referral Payments already processed are final and non-refundable, except as required by law or at the sole discretion of ClosingLeads.
- 6. Closing Verification. You agree to promptly notify ClosingLeads of any closings resulting from leads provided through the Program. This includes providing documentation such as closing statements, transaction dates, and commission details. Failure to report closings or remit Referral Payments in good faith may result in account suspension, permanent removal from the Program, and collection efforts.
- 7. Late or Failed Payments. If any Referral Payment fails, is disputed, or charged back after a closing, ClosingLeads may assess a $50 processing fee for each failed transaction and may suspend or terminate your participation in the Program. You are responsible for all costs of recovery, including reasonable attorney and collection fees.
- 8. Billing Disputes. To dispute any charge, you must contact ClosingLeads in writing at support@closingleads.com within 30 days of the charge. You agree not to initiate a chargeback with your bank or credit card provider within this 30-day period, allowing ClosingLeads time to resolve the issue. Accounts involved in chargebacks will be temporarily suspended pending resolution.
- 9. Termination. You may cancel your participation in the Program at any time by contacting support@closingleads.com. However, the Enrollment Fee remains non-refundable, and all Referral Payments owed for closed transactions remain due in full.
- 10. Modifications. ClosingLeads reserves the right to modify these Billing Terms at any time. Updated versions will be posted on this page, and continued participation in the Program after such changes constitutes acceptance of the updated terms.
